Water Arrears

The County can add the outstanding water and wastewater accounts to the tax bill for the property that was receiving the supply of the water. They may be added to taxes when they are over 90 days in arrears or if the account is inactive.

The Municipal Act Section 391 allows the County to charge individuals receiving and using the water supply. Fees and charges for the property that received the supply of water from the County can be added to the tax roll for that property. Section 398 (2) gives the County the authority to add outstanding accounts to the tax roll of the property receiving the supply of water. Ontario Regulation 581/06 gives fees and charges added to the tax roll under Section 398 (2) priority lien status. The fees can only be added to the property to which the public utility was supplied.

For Landlords and New Owners

If you are a landlord, the Energy + Inc. account for your property should be in your name, or in both yours and your tenant's name. Otherwise you will not be able to get arrears information, as it is the personal financial information of the account holder.

The water and wastewater arrears for a previous owner or a tenant can be added to your tax account because arrears are applied to the tax bill for the property the service was supplied to.

To make sure you are aware if your tenant is in arrears for water and wastewater:

  • Keep the account in your name and hand the bill to the tenant for paying,
  • Have your name placed on the account with the tenant, or
  • Have your tenant sign a water consent form, or
  • Fill out our online consent form, located on our Online Services page
