Fences

On December 19, 2023, County of Brant Council approved a new Fence By-law and Swimming Pool Enclosure By-law.

The Fences Bylaw (PDF) outlines restrictions on the height of fences in various yards. If you are considering building a fence on your property, we recommend you contact the By-law Enforcement Division to ensure that any proposed construction complies with the new regulations.

The basic fence requirements are listed below:

  • There is no regulation that affects which way the "good" side of the fence faces. The homeowner makes that determination
  • The homeowner should determine the property/lot line by reviewing their property survey
  • If there is a dispute or if the exact property/lot line cannot be determined, an Ontario Land Surveyor should be consulted. If an owner wishes to construct a fence on the property line between two properties, they should discuss the fence proposal with their neighbours. For more information, visit the Line Fences Act webpage.
  • For swimming pool enclosure information, visit the Swimming Pools webpage.

Fences on interior lots in residential zones

  • Front yard fences cannot be higher than 0.91 m (3 ft.) and cannot obstruct the visibility of motorists or pedestrians
  • Rear and interior side yard fences cannot be higher than 2.28 m (7.5 ft.)

Fences on corner lots

  • Front Yard fences cannot exceed 0.91 m (3 ft.) in height and cannot obstruct the visibility of motorists or pedestrians
  • Exterior side yard fences may exceed 0.91 m (3 ft.) in height to a maximum height of 2.28 m (7.5 ft.) provided to the fence is set back a minimum of 4.57 m (15 ft) from the exterior side yard lot line.
